FOG LIGHTS: LEGAL IN WHICH STATES? 2 Years, 3 Months ago

The road laws have changed recently in Qld, to come in line with some other states.
What state/s is it illegal to drive with your fog lights on, when there is no fog.
I know that the following 2 states it is illegal
1. NSW
2. QLD

This is a very interesting question.
As we know it is illegal in NSW, But I've been using mine on every car every day iv'e had over the years, and every day i see mulitudes of drivers also having them on these day's, but to this day i have never heard of anyone being booked for this offence!!!
A poll on this would be very interesting to see how many people have been fined
and where and when???

eleven PTs nearly got booked last year in VIC .. cruise controller got booked the rest got off with warning as officer didn't want to do all the paperwork & by then wasn't sure IF all had them on .. check out the Bright run in 2008 for details . having said that I don't drive with them on an more .... but I see PLENTY of cars with them on (many with them wrongly adjusted & glaring & when sitting behind U at night it is very annoying & dangerous) each seachange run to Gippsland .... & even on the freeway going to work & back where it is DEFINATLEY not necessary !!

My understanding is that it is a National Law as are most road rules these days. However, the penalty value changes from State to State. For example in Queensland each penalty point is worth $100. The foglight fine in QLD is $40, so I''m not quite sure how that works. I believe this varies and is more expensive in some of the southern states.
I never use my fog lights - unless I'm in the fog and we get plenty of it here in Toowoomba. I always drive with my headlights on, it just makes you that more visible. Some afternoons, I have to drive directly into the sun and I find that I can see the cars coming toward me a lot easier if they have their headlights on, and try to do the same for others. Being a motorcyclist of many years, I have realised it is all about making yourself visible to others, not always whether you can see better yourself or not (for example on overcast days).
I'm not sure if driving around with your foglights on just to see if you get booked or not is a terribly clever idea - a bit like driving around 20km over the speed limit to see how many tickets you get?????

dont drive with on anymore either. whats the go with all these new cars that you see with on all the time .are they being built so they come on when you turn the car on . thats what it looks like . there everywhere . the police would have a hard time booking all of them.

I have said it before and agree with them being out of alignment and annoying at night but don’t understand why people cant use them during the day when it makes it easier to see the car, especially black and green cars, and can probably save lives. Bikes are allowed to use lights during the day. The law should say turn them off at dusk the same as it says turn your lights on at dusk but I suppose this is just too hard for some people to remember and do and we need the government to hold our hands and tell us what to do with our lives yet again, what’s happened to good old Australia, its getting like Singapore. I remember seeing a t-shirt in Singapore that had written on it “smoke in street get a fine, forget to flush the toilet get a fine, chew gum get a fine”, etc etc. Saying all this I must point out that I don’t drive with mine on and never have unless it was foggy
Just a bit fed up off obviously not being able to think for myself and by the way I watched grumpy old men last night, which probably explains the above rant !!!!

I agree, I'm feeling like a grumpy old man this morning too (but he's already left for work) haha.
Legally, motorbikes MUST have their headlights on and roughly 25-30 years ago they changed it so that all new motorcycles were hardwired (I think thats the term), so that when you start your ignition your lights automatically come on. I wonder if thats the case with the foglights/driving lights in some x brand cars???
Also, I was wondering if they do actually mean the little lights that we call foglights, or do they mean the big yellow or blue ones that the Ute boys have on their cars?? Is there a definition somewhere in the Traffic Act (or somewhere) of a foglight?
Just out of curiousity....if you leave your foglights on when you turn your ignition off do you get the bing, bing, bing????? I know that I get the bing if I leave my headlights on and its always a good reminder.

Fog lights are becoming an increasingly common feature of new vehicles.
Front fog lights are generally low mounted, high intensity, short-range lights that may be yellow or white in colour. Rear fog lights are red in colour and are about the same intensity as a brake light.
Rear fog lights are intended to make the vehicle more conspicuous in foggy conditions, while front fog lights are intended to improve visibility by penetrating fog.
Front fog lights are often confused with driving lights. However they differ from driving lights in that they must operate independently of headlights. Driving lights may only operate in conjunction with high beam headlights. Also the beam pattern and illumination range of the two are quite different.
Misuse of fog lights is a common source of motorist complaints.

Thank you all for your input. I know the department of transport defines the road rules and the police enforce them. They rules are open to interpretation.
I know the laws about neon lights can be challenged in QLD as they have specified what colors are illegal. so some of the owners push the point by using colors not specified in the act.
due to the fact that the manual states our fog lights are the red one in the back, not ALL models came fitted with front driving light either.
It is open to debate with the local law enforces.
I have not been driving with them on knowing that they are looking for easy money at the moment and they will book us.

well I've been a bit quiet on this topic ..... I stopped using my fog lights last year when the eleven pts nearly all got booked ... BUT ... after reading the TWO signs as I was leaving BAIRNSDALE .... be safe be seen use daytime lights ...... now the first time I read it I thought what R they ??  .. second on a KMS or sao later ... I'll use the parks withthe lower ex fog lights .. NO headlights & if I get PULLED over I will say they are NOT fog lights they are DAYTIME lights ... as opposed to the BIG lights we use at night .. if I colour my hair BLOND I might get away with it !!!?? ... & I saw three police cars and none stopped me ... maybe they were not on traffic duty ?? ..... noted heaps of cars using the daytime & night time lights ... & a lot using there night time lights only and it was DAYTIME !!

I used to drive with parkers and fogs all the time - especially in a BLACK car - to be SEEN ! ? - but since all this carry on started a couple of years ago, I stopped that - can't afford the fine - and most of the time put the standard lights on - BEEPER tells me if I forget to turn them off when I get to my destination
